Can zakat or fitrah be given to someone who commits haram acts such as drinking alcohol or gambling?

Zakat is given to eight categories of people, primarily the poor, as listed in verse 60 of Surah At-Tawbah. Therefore, although it is recommended to prioritize poor people who are religiously observant when fulfilling this duty, zakat may be given to any Muslim.

If a poor person is engaged in unlawful activities and it is suspected that the zakat given may be spent on such acts, it is more appropriate—when necessary to provide for the needs of their family—to give zakat in the form of food or clothing rather than cash.
